Ways in Which to Impact Law and Policy in Hong Kong

Abstract

There are different ways in which legal academics can impact law and policy in Hong Kong. This presentation will outline and reflect on a legal research centre's engagement with government and public agencies on law reform projects. From 2009 to 2013, the Centre for Comparative and Public Law (CCPL) worked with the Department of Justice, Security Bureau, Constitutional and Mainland Affairs Bureau, Law Society of Hong Kong and Law Reform Commission of Hong Kong on reform projects, respectively related to asylum claims by torture claimants, enacting anti-stalking law, and exceptions to suspended sentences of imprisonment. No one model of engagement would have been best for all three projects. Each had its own exigencies, unexpected developments and challenges. Effective partnerships require understanding the problem from the perspective of the partner and a flexibility to accommodate the evolving requirements of the project.

Biography

Professor Simon N. M. Young is Associate Dean (Research) in the Faculty of Law, The University of Hong Kong, and a practicing barrister. He was Director of the Centre for Comparative and Public Law from 2007 to 2013. In September 2014, he started the HKU Legal Scholarship Blog to promote engagement and impact of research by teachers and students in the Faculty of Law.
